1. About these terms

These Terms of Use (“Terms”) are an agreement between you and Syshikes Solutions (“we”, “us”), which runs ParkHikes (www.syshikes.com). They apply to the ParkHikes app and its related services. By creating an account or using ParkHikes, you agree to these Terms and to our Privacy Policy.

ParkHikes lets drivers reach the owner of a car, for example when it is blocking the way, by scanning a QR tag on the car or entering its number plate, and then messaging or calling them in the app without seeing each other’s phone number.

We are an intermediary under the Information Technology Act, 2000 and the IT Rules. We do not create or check the messages, photos, notes or calls people exchange, but we act on reports and on lawful orders as described below.

2. Who can use ParkHikes

You must be 18 or older and able to enter into a contract under Indian law. You may use one account for yourself; don’t create accounts for someone else or share your login.

Give accurate details when you sign up and keep them up to date. You are responsible for everything done through your account, so keep your password safe and tell us at once if you think someone else has used it.

3. Registering cars and QR tags

Only register a car that you own or are allowed to use, with its real number plate. Never register someone else’s car or plate. A car found by its number plate is shown as “Owner not verified”, because anyone could type in a plate; only the QR tag on the car is proof.

The free plan includes 1 car; Premium includes up to 5. Place the QR tag inside the windshield or a side window where it doesn’t block the driver’s view, in line with the Central Motor Vehicles Rules. You are responsible for following traffic and parking laws.

We may hide or remove a car, its tag or its number plate from search if we believe it was registered by someone who doesn’t own it, for example after several reports.

4. Contacting other drivers

Use ParkHikes only to contact someone about their vehicle: for example that it is blocking you, its lights are on, or it is about to be towed. Don’t use it for marketing, spam, sales, dating, chain messages or anything unrelated.

In-app calls and messages go over the internet. ParkHikes is not an emergency service and calls can fail; in an emergency, call 112. Never share OTPs, passwords, bank, card or UPI details or ID documents with anyone you meet through ParkHikes, and never send them money.

Number plate scanning (1 photo scan a week, or 3 a day with Premium; scanning may be paused if the app-wide limit is reached) is only for finding the owner of a car in front of you. Don’t use it, or plate search, to look up, track or collect information about people or vehicles.

5. What you must not share

As required by Rule 3(1)(b) of the IT Rules, you must not host, display, upload, send, share or call to communicate anything that:

(i) belongs to someone else and you have no right to; (ii) is obscene, pornographic, paedophilic, invasive of another person’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on grounds of religion or caste with intent to incite violence; (iii) is harmful to children;

(iv) infringes any patent, trademark, copyright or other proprietary right; (v) deceives or misleads anyone about where a message came from, or knowingly and intentionally communicates misinformation or anything patently false or misleading; (vi) impersonates another person;

(vii) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries, or public order, incites any cognisable offence, prevents the investigation of any offence, or insults any other nation; (viii) contains a software virus or any code, file or program designed to interrupt, destroy or limit the functionality of any computer resource; or (ix) breaks any law in force.

You also must not threaten, abuse, stalk or harass anyone, try to find out someone’s phone number or address, misuse the reporting tools, scrape or copy data, or interfere with or try to get around our security or limits.

6. Reports, removal and suspension

You can report a chat (⋮ → Report chat) or a car that isn’t its owner’s (“This isn’t the owner”), or email the Grievance Officer. We review reports and may remove content, hide cars, limit features, or suspend or close accounts that break these Terms or the law, with or without notice.

If you break these Terms, we have the right to end your access to ParkHikes immediately and remove anything you shared. We remind all users of this at least once a year.

When we receive a court order or a lawful direction from the Government, we will remove or disable access to the information concerned within the time the law requires (for most orders, 36 hours) and may share information with authorised government agencies as the law requires.

As the IT Rules require, we keep information that we remove, and records related to it, for 180 days (or longer if a court or authority asks), and we keep the details you registered with for 180 days after you delete your account. After that it is deleted.

7. Grievance Officer and complaints

We acknowledge every complaint within 24 hours and resolve it within 15 days. Requests to remove content that breaks the rules above are acted on within 72 hours. If you complain that content shows you in a sexual act, exposes your private areas or nudity, or impersonates you (including morphed images), we will remove or disable it within 24 hours.

If you are not satisfied with the Grievance Officer’s decision, you may appeal to the Grievance Appellate Committee set up by the Government of India within 30 days of receiving it.

8. Premium, payments and refunds

New accounts get a 7-day Premium trial. Premium costs ₹99/month (inclusive of applicable taxes unless stated otherwise) and renews monthly through Razorpay UPI Autopay or card until you cancel. Prices may change; we will tell you before a change applies to you.

You can cancel any time from Premium → Cancel subscription; you keep Premium until the end of the period you have paid for. Payments already made aren’t refunded automatically, but email us if something went wrong and we’ll look at it fairly. Razorpay’s own terms also apply to payments.

Invite rewards (50% off your first Premium month, or 7 extra Premium days, per friend who joins with your code and adds a car) are limited to 10 per account, have no cash value, and may be withdrawn if they are earned through fake accounts or other misuse.

9. Your content and our app

You keep ownership of the messages, photos and notes you send. You give us permission to store, transmit and display them only as needed to run ParkHikes for you and the people you contact, and to review them when they are reported.

ParkHikes, its design, name, logo and software belong to Syshikes Solutions. You may use the app for its intended purpose; don’t copy, modify, sell or reverse-engineer it.

10. Disclaimers and liability

ParkHikes is provided “as is”. We don’t guarantee that a car owner will be reachable, reply or move their car, that a number plate match is correct, or that calls, messages or notifications will always work. We are not party to, or responsible for, disputes between drivers, parking or traffic matters, or anything people say or do through the app.

To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you for any claim is limited to the amount you paid us for Premium in the 3 months before the claim. Nothing in these Terms limits rights you have under consumer protection law that can’t be limited.

11. Ending your use

You can stop using ParkHikes and delete your account any time from Profile → Delete account. We may suspend or close your account as described above, or if we stop offering ParkHikes, in which case we’ll tell you first where we can.

12. Changes, law and contact

We may update these Terms. If a change is significant, we will tell you in the app before it takes effect; continuing to use ParkHikes after that means you accept the new Terms.

These Terms are governed by the laws of India. Any dispute will be handled by the courts at Hoshangabad, Madhya Pradesh.
